Covered institutions must provide customer notice as soon as practicable, but not later than 30 days, after becoming aware that unauthorized access to or use of customer information has occurred (or is reasonably likely).
And the compliance dates are concrete: December 3, 2025 for larger entities and June 3, 2026 for smaller entities.
These requirements turn vendor incidents and data exposure events into leadership-level, time-sensitive decisions — especially when the facts evolve over hours or days.
GenAI Expands the Leakage Surface — Often Outside Approved Controls
Executives need to understand the operational reality:
- 15% of employees were routinely accessing GenAI systems on corporate devices
- Among those users, 72% used non-corporate emails as account identifiers
- 17% used corporate emails without integrated authentication
For financial services, this creates immediate challenges: identity enforcement, retention, logging, and evidence. If GenAI usage occurs outside corporate authentication and monitoring, it becomes much harder to prove control—and much harder to quickly scope incidents.
Synthetically generated text in malicious emails has doubled over the past two years, reinforcing how AI is accelerating both productivity and threat activity.

Third-party Exposure is Rising — and AI Increases Vendor Dependency
Financial services firms increasingly adopt AI through vendors: platform features, integrations, and “AI-enabled” support tools. That expands third-party reliance at the same time third-party breach involvement is increasing.

Under Regulation S-P, vendor oversight becomes operational—not just contractual. Firms need to know which vendors handle customer information and how quickly they can obtain the information needed to make decisions within the notification window.
Governance-first Readiness: What It Looks Like When Time is Limited
Strong readiness shows up as decisiveness under pressure.
Organizations that handle AI-related risk well in financial services tend to share a few characteristics:
- Exposure visibility: They can quickly identify the tools, systems, and vendors involved, and which customer information may be affected.
- Clear data boundaries: Teams know what cannot be used in prompts or uploads, and controls reinforce that boundary.
- Identity and auditability: AI access is tied into corporate identity and logging wherever feasible, reducing blind spots and improving evidence.
- Vendor readiness that supports action: Contracts define notification expectations, escalation paths, and evidence requirements.Iinventories map vendor access to customer information.
- Integrated incident response: Incident response programs include AI workflows and vendor AI exposure, with Legal, Compliance, IT, and leadership aligned on decision rights.
This is also where broader reporting expectations come into play. For NYDFS-regulated entities, Part 500 requires notice to the superintendent as promptly as possible, but no later than 72 hours from the determination of certain cybersecurity events.
SEC rules generally require disclosure of a material incident on Form 8-K within four business days of determining materiality.
The point isn’t to overwhelm teams with clocks — it’s to design governance that functions when those clocks overlap.
